The warranties contained in this Warranty are limited to the following Clarius-branded products purchased directly from Clarius (the \u201cCovered Products\u201d herein):&#13;<br \/>\n&#13;<\/p>\n<ul class=\"wp-block-list\">&#13;<\/p>\n<li style=\"list-style-type: none;\">&#13;\n<ol>&#13;<\/p>\n<li>Neu hergestellte Clarius-Ultraschallscanner (&#8222;Neue Clarius-Scanner&#8220;);<\/li>\n<p>&#13;<\/p>\n<li>\u00dcberholte oder wiederaufbereitete Clarius-Ultraschallscanner (&#8222;\u00fcberholte Clarius-Scanner&#8220;); und<\/li>\n<p>&#13;<\/p>\n<li>Neu hergestellte Batterien, Ladeger\u00e4te, Ladekabel und sonstiges Zubeh\u00f6r (zusammenfassend &#8222;Neue Batterien und Zubeh\u00f6r&#8220;).<\/li>\n<p>&#13;\n<\/ol>\n<p>&#13;\n<\/li>\n<p>&#13;\n<\/ul>\n<p>&#13;<\/p>\n<p style=\"padding-left: 40px;\">\nThe\u00a0warranty details\u00a0herein\u00a0only apply to Clarius ultrasound scanners and products purchased directly from Clarius.\u00a0 If you purchased your Clarius scanner and products from a distributor, please contact them and refer to the documentation accompanying your purchase for warranty coverage details.<\/p>\n<p style=\"padding-left: 40px;\">\n<strong>Limited Warranty<\/strong>. Clarius warrants to customer that each Covered Product will be free from defects in materials and workmanship, subject to the limitations set out herein.\u00a0\u00a0 This warranty is made to the original customer only and, unless agreed to by Clarius in advance, does not extend to any subsequent purchaser or transferee of the Covered Product.&#13;<\/p>\n<p style=\"padding-left: 40px;\">\n<strong>Warranty Period<\/strong>. The warranty period for all warranties is limited in time in accordance with Section 4 (Warranty Types) below.\u00a0 The initial warranty period begins on the date that Clarius delivers the Covered Products to customer, and if the order contains multiple shipments, the date the first item is delivered.\u00a0 The warranty period for any replacement product or component, or repair to a Covered Product, furnished to customer as a warranty remedy will be the unexpired portion of the original warranty period of the repaired, adjusted or replaced Covered Product.&#13;<\/p>\n<p style=\"padding-left: 40px;\">\n<strong>Third Party Products<\/strong>. Clarius does not provide a warranty or warranty service for products that are manufactured by a third party and do not carry the Clarius label, even if such Products are sold and distributed by Clarius. All warranty terms (if any) for such Products are provided by the third party manufacturer and are governed by documentation provided by the manufacturer and included with the shipment to customer or available online from the manufacturer\u2019s website.&#13;<br \/>\n&#13;<\/p>\n<ol class=\"wp-block-list\" start=\"2\">&#13;<\/p>\n<li><strong>Einzige Garantie-Rechtsbehelfe<\/strong><\/li>\n<p>&#13;\n<\/ol>\n<p>&#13;<\/p>\n<p style=\"padding-left: 40px;\">\nClarius\u2019 obligation and liability under the Limited Warranty of a Covered Product is limited solely, at Clarius\u2019 option: to repair, adjust or replace (with new or exchanged replacement parts or devices) the non-conforming Covered Product, or, in the alternative, repayment or reduction of a reasonable portion of the purchase price for the Covered Products, as determined by Clarius in its sole discretion.\u00a0 THE REMEDY SELECTED BY CLARIUS IN ACCORDANCE WITH THIS PARAGRAPH SHALL BE THE EXCLUSIVE AND SOLE REMEDY OF CUSTOMER FOR ANY BREACH OF WARRANTY.<br \/>\n&#13;<\/p>\n<ol class=\"wp-block-list\" start=\"3\">&#13;<\/p>\n<li><strong>Ausschl\u00fcsse von der Garantie<\/strong><\/li>\n<p>&#13;\n<\/ol>\n<p>&#13;<\/p>\n<p style=\"padding-left: 40px;\">\nThe Limited Warranty of the Covered Products do not cover:<br \/>\n&#13;<\/p>\n<ul class=\"wp-block-list\">&#13;<\/p>\n<li style=\"list-style-type: none;\">&#13;\n<ol>&#13;<\/p>\n<li>Jegliche Arbeiten au\u00dferhalb der abgedeckten Produkte.<\/li>\n<p>&#13;<\/p>\n<li>Jegliche Sch\u00e4den an den abgedeckten Produkten, die durch eine externe Quelle verursacht werden, unabh\u00e4ngig von ihrer Art.<\/li>\n<p>&#13;<\/p>\n<li>Wartung, Anschluss oder Entfernung von Ger\u00e4ten an den abgedeckten Produkten, die nicht von Clarius geliefert wurden.<\/li>\n<p>&#13;<\/p>\n<li>Reparatur oder Ersatz von Sch\u00e4den, Defekten, M\u00e4ngeln oder Verlusten, die ganz oder teilweise auf Folgendes zur\u00fcckzuf\u00fchren sind: (1) die Verwendung der Abgedeckten Produkte in einer anderen Art und Weise oder in einer anderen Konfiguration als in den von Clarius zur Verf\u00fcgung gestellten Anleitungen, Spezifikationen, Handb\u00fcchern oder sonstigen Dokumentationen angegeben (einschlie\u00dflich der Verwendung der Abgedeckten Produkte f\u00fcr Off-Label-Zwecke oder mit einem Ger\u00e4t, das nicht in der Liste der kompatiblen intelligenten Ger\u00e4te aufgef\u00fchrt ist, die Clarius in seinem Betriebshandbuch oder auf seiner Website angegeben hat); (2) unsachgem\u00e4\u00dfe Lagerung, Handhabung, Verwendung oder Wartung der Abgedeckten Produkte; (3) Nichteinhaltung der empfohlenen oder \u00fcblichen Umgebungsbedingungen; (4) Demontage, \u00c4nderungen oder Reparaturen, die von anderen als den von Clarius autorisierten Personen durchgef\u00fchrt wurden; oder (5) jede andere Ursache, die au\u00dferhalb der zumutbaren Kontrolle von Clarius liegt, einschlie\u00dflich derer, die sich aus Unf\u00e4llen, Nachl\u00e4ssigkeit, Fahrl\u00e4ssigkeit, Missbrauch, Zweckentfremdung, vors\u00e4tzlicher Besch\u00e4digung, Diebstahl, Vandalismus oder Katastrophen (wie z. B. \u00dcberschwemmungen, Erdbeben, Feuer, Krieg, Epidemien, Unruhen, Milit\u00e4raktionen, Terroranschl\u00e4ge oder h\u00f6here Gewalt) ergeben.<\/li>\n<p>&#13;<\/p>\n<li>Upgrades oder andere Modifikationen der Abgedeckten Produkte, die mit Materialien durchgef\u00fchrt wurden, die nicht von Clarius geliefert wurden, einschlie\u00dflich, aber nicht beschr\u00e4nkt auf Software-, Firmware- oder Hardware-Modifikationen der Abgedeckten Produkte.<\/li>\n<p>&#13;<\/p>\n<li>Jegliche Arbeit zu kosmetischen Zwecken.<\/li>\n<p>&#13;<\/p>\n<li>Verbrauchsmaterial.<\/li>\n<p>&#13;<\/p>\n<li>Batterien und Zubeh\u00f6r nach Ablauf der Garantiezeit der Standardgarantie f\u00fcr diese Artikel (wie in Abschnitt 4(a) unten definiert).<\/li>\n<p>&#13;<\/p>\n<li>Das Vers\u00e4umnis, ordnungsgem\u00e4\u00df qualifiziertes, geschultes und lizenziertes Personal f\u00fcr den Betrieb der Abgedeckten Produkte einzusetzen.<\/li>\n<p>&#13;<\/p>\n<li>Alle abgedeckten Produkte, die mit Blut oder anderen potenziell infekti\u00f6sen Substanzen kontaminiert sind.<\/li>\n<p>&#13;\n<\/ol>\n<p>&#13;\n<\/li>\n<p>&#13;\n<\/ul>\n<p>&#13;<br \/>\n&#13;<\/p>\n<ol class=\"wp-block-list\" start=\"4\">&#13;<\/p>\n<li><strong>Garantie-Typen<\/strong><\/li>\n<p>&#13;\n<\/ol>\n<p>&#13;<\/p>\n<p style=\"padding-left: 40px;\">\n(a)\u00a0Standard Warranty:\u00a0 If there is a breach of the Limited Warranty of Section 1 above for any Covered Product within the Warranty Period (defined below), Clarius will: provide all replacement device parts, software updates and image upgrades (excluding new features) which Clarius regularly makes available to its customers of such products at no additional fee; and, if necessary, provide replacement products of equivalent or better condition.\u00a0 If Clarius replaces a Covered Product, the original product becomes Clarius\u2019 property and the replacement product becomes the customer\u2019s property.<\/p>\n<p style=\"padding-left: 40px;\">\nOne-way standard shipping will be provided.\u00a0 This means the cost of shipping any Covered Product to Clarius will be at the sole cost of the customer.\u00a0 However, Clarius will pay the costs for shipping of any repaired or replacement product or parts to the customer. Delivery of any repaired or replacement device or parts shall be provided by standard shipping (e.g., ground) speeds.<\/p>\n<p style=\"padding-left: 40px;\">\nThe warranty period for the different Covered Products defined in Section 1 above (the \u201cWarranty Period\u201d) are:<\/p>\n<p style=\"padding-left: 80px;\">\n(1) New Clarius Scanners:\u00a0 three (3) years<\/p>\n<p style=\"padding-left: 80px;\">\n(2) Refurbished Clarius Scanners:\u00a0 one (1) year<\/p>\n<p style=\"padding-left: 80px;\">\n(3) New Batteries and Accessories: \u00a0six (6) months<\/p>\n<p style=\"padding-left: 40px;\">\nTo obtain warranty service, the customer must email\u00a0<a href=\"mailto:support@clarius.com\">support@clarius.com<\/a>\u00a0to obtain a Return Materials Authorization (RMA) number from Clarius prior to returning any non-conforming Covered Product, and follow all instructions of Clarius.\u00a0Title to and the risk of loss, damage or casualty to the Covered Product remains with customer until delivery to Clarius.\u00a0Clarius Product Purchase terms and conditions govern the return of repaired or replacement Covered Product to customer. To comply with applicable health authority regulations, warranty claims must be made in the country where the Covered Product was purchased.&#13;<\/p>\n<p style=\"padding-left: 40px;\">\n(b) Clarius Care:\u00a0 For an additional charge, Clarius Care provides the following enhanced warranty services:<\/p>\n<p style=\"padding-left: 80px;\">\n(1) for New Clarius Scanners, notwithstanding the exclusion of coverage for accidental damage in Section 3(4)(5) above (Warranty Exclusions), Clarius will repair or replace a New Clarius Scanner damaged by accidental damage; provided, however, that no New Clarius Scanner will be repaired or replaced under a claim of accidental damage more than once over any twelve (12) month period;<\/p>\n<p style=\"padding-left: 80px;\">\n(2) for New Clarius Scanners, notwithstanding the exclusion of coverage for theft in Section 3(4)(5) above (Warranty Exclusions), Clarius will replace a New Clarius Scanner stolen from the premises of an accredited hospital; provided, however, that (i) the stolen New Clarius Scanner must have been previously registered with the accredited hospital\u2019s asset management system, (ii) replacement of a New Clarius Scanner under a claim of hospital theft will only be permitted a single time during the Clarius Care coverage period, and (iii) the Customer acknowledges that once the New Clarius Scanner is reported stolen, use of the stolen scanner will be immediately remotely terminated by Clarius;<\/p>\n<p style=\"padding-left: 80px;\">\n(3) for a new battery, notwithstanding Section 3(8) above (Warranty Exclusions), the coverage of the Standard Warranty will be available for the duration of the Clarius Care coverage period; provided, however, that no new battery will be repaired or replaced more than once over any twelve (12) month period;<\/p>\n<p style=\"padding-left: 80px;\">\nand<\/p>\n<p style=\"padding-left: 80px;\">\n(4) for a legitimate warranty claim requiring repair or replacement of a New Clarius Scanner or new battery, Clarius will (i) pay for shipping of the non-conforming New Clarius Scanner or battery to Clarius, and (ii) pay for shipping to provide customer with a loaner scanner or battery; provided, however, that (x) Clarius reserves the sole right to select the shipping method used to deliver the loaner scanner or battery to customer, and (y) if the loaner scanner or battery has equivalent or better functionality, Clarius may, in its sole discretion, elect to consider the loaner scanner or battery a replacement such that Clarius keeps the customer\u2019s original scanner or battery.<\/p>\n<p style=\"padding-left: 40px;\">\nClarius Care enhanced warranty services are available for a one (1), two (2), or three (3) year period that, if purchased, begins and runs concurrently with the Warranty Period of the Standard Warranty.\u00a0 If Clarius Care is purchased for a one (1) or two (2) year period, the Clarius Care enhanced warranty services will expire prior to the expiry of the Standard Warranty\u2019s Warranty Period, but such expiry will not affect the remaining unexpired portion of the Standard Warranty\u2019s Warranty Period.\u00a0 In no event will the purchase of a Clarius Care enhanced warranty extend the warranty period of a New Clarius Scanner or new battery beyond three (3) years.<\/p>\n<p style=\"padding-left: 40px;\">\nIf making a claim under Clarius Care, all other terms and conditions for obtaining warranty service under the Standard Warranty shall apply.<\/p>\n<p style=\"padding-left: 40px;\">\nFor greater clarity, \u201caccidental damage\u201d under Clarius Care is limited to damage that negatively impacts the functioning of the covered New Clarius Scanners, and \u201caccidental damage\u201d will not include coverage for any cosmetic or superficial damage.\u00a0 Further, Clarius reserves the right to inspect all New Clarius Scanners returned to Clarius under a claim of accidental damage, and Clarius may deny coverage under Clarius Care\u2019s enhanced warranty services if Clarius determines that damage did not arise as a result of accidental damage of the Clarius Scanner.\u00a0 Such inspection may include: a visual inspection of the Clarius Scanner and\/or a review or analysis of sensor data collected by the returned Clarius Scanner.<\/p>\n<p style=\"padding-left: 40px;\">\nClarius will take all reasonable measures to have the repair services described in this Section 4 be performed by qualified personnel in a professional manner.\u00a0 However, such measures shall not be deemed to extend
